General Terms and Conditions

These Terms and Conditions govern your use of the Company website (the “Company Site”) and your relationship with S & B Retailers Limited t/a SUSIE WEST (the “Company”, “we” or “us”). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not use or order from the Company Site. 1 Use of the Company Site

1.1 The Company Site is provided to you for your personal use subject to these Terms and Conditions. By using the Company Site you agree to be bound by these Terms and Conditions. References to these Terms and Conditions include the Sale of Goods Terms and our Privacy Policy also found on the Company Site.
1.2 To use or order off the Company Site you must be over eighteen years of age.

2 Amendments

2.1 We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Company Site. Any changes will be notified to you via the e-mail address provided by you on the placing of your order or via a suitable announcement on the Company Site. The changes will apply to the use of the Company Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Company Site. If you continue to use the Company Site after the date on which the change comes into effect, your use of the Company Site indicates your agreement to be bound by the new Terms and Conditions.

3.1 The content of the Company Site is protected by copyright, trade marks, database right and other intellectual property rights. 4 Your use of the Company Site

4.1 You may not use the Company Site for any of the following purposes:
4.1.1 disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
4.1.2 transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;
4.1.3 interfering with any other person’s use or enjoyment of the Company Site; or
4.1.4 making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
4.2 You will be responsible for our losses and costs resulting from your breach of this clause

5 Availability of the Company Site

5.1 Although we aim to offer you the best service possible, we make no promise that the services at the Company Site will meet your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with the Company Site you should report it to info@susiewest.co.uk (or write or fax to the contact details contained at the end of these Terms and Conditions) and we will attempt to correct the fault as soon as we reasonably can.
5.2 Your access to the Company Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

6 The Company’s liability

6.1 The Company Site provides content from other Internet sites or resources and while the Company tries to ensure that material included on the Company Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If the Company is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.
6.2 If we are in breach of these Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you use the Company Site. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.
6.3 This clause 6 shall not limit or affect our liability resulting from any products sold through the Company Site being found to be unsafe or if something we do negligently causes death or personal injury.

7 Third Party Websites

7.1 As a convenience to customers, the Company Site may include links to other web sites or material which are beyond its control. The Company is not responsible for content on any site outside the Company Site.

8 Advertising and Sponsorship

8.1 Part of the Company Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Company Site complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

9 Applicable Law

9.1 These Terms and Conditions will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.

10 International Use

10.1 We make no promise that materials on the Company Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Company Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

11 Miscellaneous

11.1 You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
11.2 If you breach these Terms and Conditions and the Company chooses to ignore this, the Company will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
11.3 The Company shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.

Sale Of Goods

1 The contract between us

We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

2 Price

2.1 The prices payable for goods that you order are as set out in our website.

2.2 You will be required to pay extra for delivery and it might not be possible for us to de-liver to some locations. Our delivery charges are set out in our website.

2.3 Your credit/debit card details will be encrypted to minimise the possibility of unauthor-ised access or disclosure. Authority for payment must be given at the time of placing your order.

3 Right for you to cancel your contract

3.1 We hope you will be happy with your purchases. However, you may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.

3.2 To cancel your contract you must notify us in writing by any of the following methods:

3.3 If you have received the goods before you cancel your contract then you must send the goods back in their original condition to our contact address at your own risk unless the item is defective or we have delivered the item to you in error (if this the case please follow the procedures outlined in clause 6). If you cancel your contract but we have al ready processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible. If we do not receive the item back from you we may arrange for collection of the item from you at your cost.

3.4 When we receive notice of cancellation of your contract for any item, we will refund the price paid by you for that item or at your request if the item is defective will repair the item or supply you with a replacement item. We will not refund the delivery charge for sending the item to you unless you are returning an entire order.

4 Cancellation by us

4.1 We reserve the right to cancel the contract between us if:

4.1.1 we have insufficient stock to deliver the goods you have ordered;
4.1.2 we do not deliver to your area; or 4.1.3 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

4.2 If we do cancel your contract we will notify you by e-mail and will re-credit to your ac-count any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

5 Delivery of goods to you

5.1 We will deliver the goods ordered by you to the United Kingdom address you give us for delivery at the time you make your order. We will deliver your order to the main entrance of the delivery address. All goods must be signed for on delivery by an adult aged 18 years or over.

5.2 We will use our reasonable endeavours to deliver at the address given by you in accor-dance with clause 5.1 within 3-5 working days.

5.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

6 Liability

6.1 If the goods we deliver are not what you ordered or are damaged or defective or the deliv-ery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at info@susiewest.co.uk of the problem within 7 working days of the delivery of the goods in question.

6.2 If you do not receive goods ordered by you within 30 days of the date on which you or-dered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be, at your op-tion:

6.2.1 to make good any shortage or non-delivery;
6.2.2 to replace or repair any goods that are damaged or defective; or
6.2.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.

6.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever aris-ing out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 6.2.3 above.

6.4 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by cer-tain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

6.5 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

7 Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at S & B Retailers Limited trading as Susie West, 92-94 Gipsy Lane Leicester LE4 6RE or at our e-mail address info@susiewest.co.uk and all notices from us to you will be displayed on our website from to time.

8 Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

9 Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these condi-tions will not be affected.

10 Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

11 Third party rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

12 Governing law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

13 Entire agreement

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the sup-ply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudu-lent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
